Guardian for Minor - Filing Timeline

Once appointed and qualified, guardians for minors must file an Inventory of assets and income that have come under the possession and control of the conservator and file annual accountings with the Commissioner. Failure to meet the filing deadlines for the Inventory and accountings will result in enforcement action by the Commissioner as required by law; and delinquency fees must be paid personally be the conservator and not from the conservatorship assets.

Inventory

The Inventory must be filed with the Commissioner within four (4) months after the date the guardian for a minor qualifies with the Clerk of Court, along with supporting documents as may be described in the Inventory instructions or as required by the Commissioner's office.

First Accounting

The First Accounting must be filed with the Commissioner's office within six (6) months after the date of qualification of the conservator with the Clerk of Court , along with supporting documents as may be described in the Accounting instructions or as may be required by the Commissioner's office.  The First accounting must cover the period of four months immediately following the date of the qualification of a guardian for a minor with the Clerk of Court. 

Second and Subsequent Accountings

Second and subsequent accountings are due within 16 months from the ending date of the prior accounts, and should cover the 12 month period immediately following qualification of a guardian for a minor with the Clerk of Court. You may end the account on any day of a month.  Follow the Instructions. 

Example Timeline:

February 1 Guardian for a Minor qualifies with the Clerk of Court, and the First accounting period begins.

May 31 First accounting period ends (4 months after qualification). 

June 1 Second accounting period begins. 

July 31 Filing date for the First accounting (six months after qualification).

May 31 Second Accounting period ends. 

June 1 Third accounting period begins. 

Sept. 30 Filing date for Second accounting.
